The website and the application are hosted by Amazon Web Services (AWS).

Below, the owner is referred to as "GoPOS", and the website together with the application as "the Site".

2. Purpose of the Site

The Site exists to present the GoPOS product, allow subscription and account sign-up, and give access to the application to customers who have subscribed.

GoPOS is a cloud POS for mobile phone shops. It includes counter sales, VERI*FACTU invoicing with the AEAT QR code, inventory with IMEI and serial number tracking, repair jobs, warranties, trade-in contracts for used devices, quotations, expenses, multi-shop management, reports, user roles (admin, sales, repair, wholesale) and PWA operation with offline support.

Information published on the Site about features is descriptive and commercial in nature. The specific contractual terms of the service are set out in the Subscription Terms accepted at sign-up.

3. Conditions of access and use

Access to the public part of the Site is free of charge. Access to the application requires an active account and personal credentials.

The user undertakes to use the Site in accordance with the law, good faith and this Legal Notice, and not to use it for unlawful purposes or in ways harmful to GoPOS or to third parties.

It is prohibited to attempt to access restricted areas, alter or interfere with the operation of the service, introduce malicious code, reverse engineer the software, without prejudice to the acts a lawful user may carry out under Articles 100.5 and 100.6 of the consolidated Spanish Intellectual Property Law, which this prohibition does not affect, or extract content or data from the Site in bulk or by automated means.

The user is responsible for keeping credentials confidential and for activity carried out with them, and must inform us without delay of any unauthorised use.

GoPOS may suspend or terminate access for anyone who breaches these conditions, without prejudice to any other remedies available to it.

4. Sign-up, plans and subscription

The published plans are: POS Starter, EUR 29.99 per month or EUR 399 per year; POS Plus, EUR 49 per month or EUR 499 per year; POS Pro, EUR 99 per month or EUR 999 per year. A free trial is available, lasting 2 days on some plans.

All prices shown are in euros and do not include VAT or other applicable indirect taxes, which will be added to the invoice at the rate in force.

Prices, applicable taxes, payment method, term, renewal and cancellation are detailed during the subscription process and in the Subscription Terms, which prevail over any summary published on the website.

Payments are processed through [PASARELA_PAGO]. Payment data is handled within the payment provider's environment, under its own terms and security measures.

The service is aimed at businesses and professionals. Where the subscriber qualifies as a consumer, the mandatory rules of Royal Legislative Decree 1/2007 of 16 November, approving the consolidated text of the General Law for the Defence of Consumers and Users, also apply.

5. Intellectual and industrial property

The GoPOS software, its source and object code, the interface, the database, the documentation, and the texts, images, designs, logos and other elements of the Site belong to GoPOS or its licensors and are protected by Royal Legislative Decree 1/1996 of 12 April, approving the consolidated text of the Spanish Intellectual Property Law, and by Law 17/2001 of 7 December on Trade Marks.

Subscribing to the service grants the customer a personal, limited, non-exclusive and non-transferable right to use the software for the term of the contract. It does not involve any assignment or transfer of intellectual or industrial property rights.

Reproducing, distributing, communicating to the public, transforming, decompiling, sublicensing or reselling the software or the contents of the Site is not permitted without written authorisation from GoPOS, except where the law expressly allows it, in particular under Articles 100.5 and 100.6 of the consolidated Spanish Intellectual Property Law.

The data the customer enters into the application (sales, inventory, customers, repairs) remains the customer's. GoPOS acquires no ownership over it.

Third-party trade marks, trade names or logos appearing on the Site belong to their respective owners and are shown for identification purposes only.

6. Links

The Site may contain links to third-party pages. GoPOS does not control and accepts no responsibility for their content, services or policies, in the terms of Article 17 of Law 34/2002 (LSSI-CE).

If GoPOS obtains actual knowledge that linked content is unlawful or infringes the property or rights of a third party, it will remove the link as diligently as possible.

Linking to the Site's home page is permitted provided it is done fairly, without reproducing its content, without creating confusion as to origin and without suggesting a commercial relationship or sponsorship that does not exist. GoPOS may request the removal of any link.

7. Exclusion of liability

GoPOS applies reasonable means to keep the service available and working correctly, but cannot guarantee the complete absence of interruptions, errors or incidents, nor the continuous operation of the networks, devices or third-party services needed to reach the application.

GoPOS is not liable for damage arising from improper use of the service, from incorrect data entered by the user, from the loss or disclosure of credentials, or from commercial or tax decisions the customer takes on the basis of information generated by the application.

GoPOS is a tool that supports compliance. The application is designed and maintained with the aim of meeting the technical requirements applicable to invoicing software systems under Royal Decree 1007/2023 of 5 December and its implementing rules, Law 11/2021 of 9 July on measures to prevent and combat tax fraud, and Article 29.2.j) of Law 58/2003 of 17 December, the General Tax Act, including generation of the QR code. Any formal declaration of conformity will, where applicable, be issued separately and in writing, not through this Legal Notice.

GoPOS does not guarantee or certify the customer's tax, accounting or legal compliance: the taxpayer is always the shop, which is responsible for the accuracy, integrity and retention of its records.

Apart from any formal declarations issued in writing as indicated in the preceding paragraphs, GoPOS does not claim to hold any other certifications, audits, seals or approvals other than those expressly stated in writing.

Nothing in this clause excludes liability that cannot lawfully be limited, such as liability arising from wilful misconduct or from personal injury.

8. Data protection

The processing of personal data is governed by Regulation (EU) 2016/679 (GDPR) and by Spanish Organic Law 3/2018 of 5 December on the Protection of Personal Data and the guarantee of digital rights (LOPDGDD), and is described in the Site's Privacy Policy.

For data from contact forms, sign-up and billing of the service itself, GoPOS acts as data controller.

For the data a shop enters into the application about its own customers (name, phone, ID document, address) and about devices (IMEI and serial number), the shop is the data controller and GoPOS acts as data processor, handling that data only on the shop's instructions and on the terms of the Article 28 GDPR processing agreement, which is made available to the customer and accepted as part of the Subscription Terms.

GoPOS relies on providers that may act as sub-processors: [SUBENCARGADOS].

To exercise the rights of access, rectification, erasure, objection, restriction and portability over the data for which GoPOS is the controller (contact forms, sign-up and billing of the service), or for any privacy query, write to goposbcn@gmail.com or, where applicable, to goposbcn@gmail.com. If your request concerns data entered by a shop into the application, you must address that shop as data controller; GoPOS will forward your request to it without delay. You may also lodge a complaint with the Spanish Data Protection Agency (www.aepd.es).

9. Cookies and commercial communications

The Site may use cookies and similar technologies. Their use is disclosed and, where required, consent is obtained in accordance with Article 22.2 of Law 34/2002 (LSSI-CE). Details are set out in the Cookie Policy.

GoPOS only sends commercial communications by electronic means where there is prior consent or a prior contractual relationship concerning similar products, in accordance with Article 21 of Law 34/2002 (LSSI-CE).

You may object to these communications at any time through the unsubscribe link included in each message or by writing to goposbcn@gmail.com.

10. Changes and availability

GoPOS may amend this Legal Notice, the content of the Site, the features of the application and the plans and prices. Changes will be published on the Site together with their update date.

Changes affecting contracts in force will be notified as provided in the Subscription Terms.

GoPOS may temporarily suspend access to the Site for maintenance, security or update reasons, giving advance notice where possible.

11. Severability

If any clause of this Legal Notice is declared void or unenforceable, it shall be deemed not to have been included and shall not affect the validity of the remaining clauses, which will continue to apply in full.

12. Applicable law, jurisdiction and contact

This Legal Notice is governed by Spanish law.

Save where a mandatory forum applies, and without prejudice to Article 54.2 of the Spanish Civil Procedure Act (Law 1/2000 of 7 January) regarding adhesion contracts and general terms imposed by one of the parties, disputes will be heard by the courts having jurisdiction under the applicable law.

Parties acting as businesses or professionals may agree in writing, in individually negotiated Subscription Terms, to submit to the Courts of Barcelona.

Where the user qualifies as a consumer, the legally applicable forum will apply, normally that of the consumer's domicile, under Spanish law and Regulation (EU) 1215/2012.
